What is a No Win, No Fee Claim?
You may have heard the term “no win, no fee” a lot; but what does it mean? A no win no fee agreement is also known as a ‘Conditional Fee Agreement’ (CFA). When you enter into this type of agreement or contract, you will not be required to pay fees to your solicitor for legal services unless your case is successful. This takes most of the financial risks out of litigation for personal injury claims
If your case is successful, you will be required to pay a success fee and, in some circumstances, you may be required to pay for Legal Expenses Insurance/ATE insurance. This will be taken from your compensation on conclusion of your case. The remaining funds would then be transferred directly to you.

If your case is successful, the other side (defendant) will be required to pay compensation for your injuries.
In addition to claiming compensation for your injuries, you may also be able to make a claim for your additional financial losses, such as loss of earnings, care and assistance costs, medical treatment costs and travel costs if you were required to travel to and from appointments.
Our success fee will need to be deducted if you are successful in winning your case. This success fee will pay your Solicitor for their time spent working on your case. The success fee will amount to no more than 25% of your compensation amount.
In most circumstances, these fees will be deducted from your compensation when your case has been finalised.
What happens if I lose my No Win, No Fee Compensation Claim?
If your case is unsuccessful, you will not need to pay us a penny. Unfortunately, if your claim fails you will not be awarded any amount of compensation.
The ATE insurance is in place to cover you from having to pay any adverse costs, such as Court fees or expert fees if your claim does not succeed. However, you will not be required to pay for this insurance if your claim is unsuccessful.
Will I be required to sign lots of documents and paperwork?
In order to initiate your claim, we will require you to sign the Conditional Fee Agreement to confirm that you are in agreement with the no win no fee terms and conditions.
Depending on your claim and how far the claim progresses, you may need to sign additional documents, such as:
· A List of Documents- This list sets out any relevant and important details of any documents in your possession.
· Witness statements
· Court documents
· Particulars of Claim- This sets out the basis and nature of the claim against the defending party.
· Schedule of Loss- This sets out the details of your financial losses arising from the accident.
No win no fee solicitors Manchester: How much compensation will I receive?
There is no exact amount or figure which we can provide you with regarding the value of your claim. Each compensation amount will vary greatly depending on the severity of the injury, the recovery time as well as the impact the injury has had on your life.
Each personal injury case is unique, and it will be very difficult to provide a valuation on the claim with any accuracy until very late in the case.
We will discuss as the case progresses the various items which we can try to recover for you and how much you are likely to receive. It can, and often does, change throughout the case as the medical evidence develops and the recovery process takes place.
Your compensation will be split into two sections; general damages and special damages.
General Damages refers to the amount of compensation you will receive for your injury and takes into account pain, suffering and loss of amenity.
Guidelines on compensation amounts for specific injuries are set by the Judicial College, which will be used alongside recent caselaw when valuing your injuries.
Special Damages take into account financial losses and expenses you may incur due to the accident. Examples of financial losses and expenses include:
· Costs of medical treatment, such as physiotherapy or medication and prescription costs
· Travel expenses
· Loss of past and future earning
· Costs of any additional care required
How long does the claims process take?
We will do our utmost to progress your claim as quickly as possible; however, we always have to allow a certain amount of time under the Court Rules for the other side to respond.
We would always recommend that you do not settle your case until your injuries have either resolved or started to improve. Settling earlier than this would run the risk of you not receiving maximum compensation you deserve.
When someone has serious injuries, it can take a long time before the medical evidence and the associated financial losses can be finalised. We will always try and keep you advised on what we believe are realistic timescales for your case.
