No win no fee solicitors Leeds: What is no win no fee?

The legal term ‘no win, no fee’ is also referred to as the ‘Conditional Fee Agreement’ (CFA). This type of agreement means that you will not be required to pay fees for your Solicitors legal services and time if they do not win your case.

A no win, no fee agreement allows you to make a claim for an accident you were involved in that was due to a third parties negligence. This type of agreement allows you to seek injury compensation whilst also mitigating your financial risks if your claim is unsuccessful.

Winning your no win no fee compensation claim

If successful in your case, you will be awarded compensation for your injuries. The Defendant in the case will be responsible for paying your compensation.

As well as compensation for your injury, you may also be entitled to recover any additional financial losses, such as travel costs, loss of earnings, medical expenses.

As part of the no win, no fee agreement, you will be required to pay our success fee if you win your case. This success fee will compensate your Solicitor for their time spent working on your case. The success fee will amount to no more than 25% of your compensation award.

At the start of your case, your Solicitor may be required to take out a legal expenses insurance policy on your behalf to cover the costs of any disbursements, such as Court fees, or expert witness fees, if your claim fails. If your case is successful, you will also be required to pay for this insurance.

All payments required will usually be deducted from your compensation at the conclusion of your case, so you will not need to pay a penny upfront.

What happens if I lose a no win no fee claim?

The main benefit of making a claim on a no win, no fee basis is that it covers you from having to pay our fees if your case fails. You will, therefore, have no costs to pay if your claim is unsuccessful.

No win no fee solicitors Leeds: How much compensation will I receive?

There is not an exact figure we can give you for your injury claim. Each compensation amount will vary depending on the severity of the injury and how the injury has impacted your life.

Each case is different, and it is very difficult to advise on the value of the claim with any accuracy until very late in the claim.

We will discuss with you as the case progresses the various items which we can try and recover for you and how much you are likely to receive. It can and often does change throughout the case as the medical evidence develops and the recovery process takes place.

Your compensation will be split into two sections: general damages and special damages.

General Damages

General Damages refers to the amount of compensation award you will receive for your injury and takes into account pain, suffering and loss of amenity.

Guidelines on compensation amounts for specific injuries are set by the Judicial College, which will be used alongside recent caselaw when valuing your injuries.

Special Damages

Special Damages take into account financial losses and expenses you may incur due to the accident. Examples of financial losses and expenses include:

  • Medical Treatment Costs
  • Prescription Costs
  • Lost Earnings
  • Travel Expenses
  • Loss of Future Earnings
  • Cost of Care
  • Physiotherapy
  • Loss of Future Earnings
  • Costs of Home or Care

How long does it take to make a claim?

We do our best to progress your claim as quickly as possible; we have to allow a certain amount of time under the Court Rules for Defendants to respond.

However, you should never settle your claim until your injuries have either resolved or started to improve. Settling a claim before realising the extent of your injury, runs the risk of you not receiving maximum compensation.

When someone has serious injuries, it can take a long time before the medical evidence, and the associated financial losses can be finalised. We will always try and keep you advised on what we believe are realistic timescales for your case.
